Sweepstakes Rules

1. INTRODUCTION: From time to time, Program participants may be offered opportunities to participate in sweepstakes, giveaways and/or promotions (“Sweepstakes”).

The sponsor of a Sweepstake shall be Two Circles on behalf of the Buffs Premier Loyalty Program.

Any such Sweepstake shall be subject to the terms and conditions of the Buffs Premier Loyalty Program Terms and Condition (found at https://buffspremier.cubuffs.com/terms-and-conditions) and these official rules (“Official Rules”) and all applicable federal, state, and local laws and regulations and shall be void where prohibited or restricted by law.

By participating in any Sweepstakes, you unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of Two Circles, which shall be final and binding in all respects. Two Circles is responsible for the overall administration of the Sweepstakes. Questions, comments, or concerns related to a Sweepstakes should be directed to Two Circles through the Program Website via https://help.buffspremier.com/.

2. ELIGIBILITY: Sweepstakes shall be open to Buffs Premier members only (each an “Entrant,” and collectively, “Entrants”). In the event that a dispute regarding the identity of an Entrant or potential winner (each a “Winner,” and collectively, “Winners”) cannot be resolved to Two Circles’ satisfaction, the affected entry will be deemed ineligible. Entries will not be acknowledged except as provided herein.

3. PRIZES: Details of prizes and their approximate retail value (“ARV”) shall be given with the launch of any specific Sweepstake.

Limit one (1) prize per Entrant and per household. Prizes cannot be transferred, redeemed for cash, or substituted by Winner. If a prize cannot be awarded due to circumstances beyond the control of Two Circles, a substitute prize of equal or greater retail value may be awarded in Two Circles’ sole discretion. If a Winner cannot accept a prize, or any portion thereof, as stated, the prize may be forfeited at the sole discretion of Two Circles.

Any given ARV of a Sweepstake shall represent Two Circles’ good-faith determination of the maximum retail value thereof. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the given ARV, the difference will not be awarded in cash. Two Circles makes no representation or warranty concerning the appearance, safety, or performance of any prize awarded. Two Circles will not replace any lost or stolen prize items. No refunds or credit for changes are allowed.

Failure to comply with the Official Rules may result in prize forfeiture. Other restrictions, conditions, and limitations may apply.

4. HOW TO ENTER: details on how EligibleEntrants may enter any Sweepstakes shall be given on webpage at the launch of the Sweepstake.

ALTERNATIVE MEANS OF ENTRY: In lieu of the stated entry method, you may enter any Sweepstakes by sending an email to https://help.buffspremier.com/ with the subject line “Buffs Premier Sweepstake Entry” and including your full name, email address, daytime phone number, residential address, and detail of the Sweepstake you are entering in the body of the email.

Entries generated by a script, macro, or other automated means will be disqualified. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by Entrants becomes the property of Two Circles and shall be handled in accordance with the Program privacy notice at https://buffspremier.cubuffs.com/privacy-policy.

ELIGIBLE ENTRANTS MUST SUBMIT THE REQUESTED ENTRY INFORMATION IN ACCORDANCE WITH THESE OFFICIAL RULES. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED.

Participation in the Sweepstakes constitutes Entrant’s understanding of, full and unconditional agreement to, and acceptance of these Official Rules. Two Circles reserves the right to disqualify any Entrant that Two Circles determines to be in violation of any term contained in these Official Rules. Two Circles’ decision not to enforce a specific provision of these Official Rules does not constitute a waiver of that provision or of the Official Rules generally.

5. DRAWING, WINNER SELECTION, AND WINNER NOTIFICATION: Two Circles is solely responsible for the collection and processing of entries. A random drawing to select Winners from among all eligible entries received shall be undertaken promptly following the Sweepstake deadline as detailed in the webpage for any specific Sweepstake. Odds of winning will vary depending on the number of eligible entries received.

Promptly after the random drawing, potential Winners will be notified by Two Circles using the contact information provided at the time of entry. Two Circles is not responsible for any delay of or failure to receive notification for any reason, including (but not limited to) inactive email account(s) or telephone numbers, related technical difficulties, or failure to adequately monitor email account(s) or voicemail boxes.

Potential Winner(s) may be required to verify, address, sign, and return an affidavit of eligibility, release of liability, and, unless prohibited by law, a publicity release and other legal documents as may be required by Two Circles in its sole discretion (collectively, the “Prize Claim Documents”). Failure to return the Prize Claim Documents within the specified time period may result in forfeiture of the prize and selection of an alternate potential Winner from the remaining eligible entries. Two Circles will attempt to contact up to three (3) potential Winners in accordance with the above procedure, after which the prize may go unawarded if it remains unclaimed. Two Circles reserves the right to disqualify anyone not fully complying with the Official Rules.

Winner(s) will be solely responsible for all federal, state, and/or local taxes, fees, and surcharges (if applicable), including (but not limited to) fees or costs associated with the prize they receive and the reporting consequences thereof. Other restrictions, conditions, and limitations may apply.

6. PRIVACY: Any personal information supplied by you to Two Circles will be subject to the Buffs Premier privacy policy posted at https://buffspremier.cubuffs.com/privacy-policy. By entering the Sweepstakes, you grant Two Circles permission to share your email address and any other personally identifiable information, including information and/or materials provided at the time of entry, with necessary parties for the purpose of administration and prize fulfillment or as otherwise outlined herein and/or in the privacy policy.

7. LIMITATION OF LIABILITY: By entering this Sweepstakes, Entrants waive all right to, and hold Two Circles and University of Colorado Athletics and any of their respective present or future affiliates, partners, agents, employees, successors, assigns or third-party content providers, vendors or licensors (collectively, the “Limited Parties”) harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this Sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. The Limited Parties will not be responsible for: late, incomplete, or incorrect entries; an Entrant’s failure to receive prize notices due to an Entrant’s spam, junk email, or other security settings or for an Entrant’s provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications, whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; any human error that may occur in the processing of the entries in this Sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the Sweepstakes, or announcement of the prizes. If, in the Two Circles’ opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the Sweepstakes, Two Circles reserves the right to, in its sole discretion, cancel or modify this Sweepstakes in a manner it deems appropriate. In the event of termination, Winners will be selected from among all eligible entries received as of the date of termination.
